Justice Jasmeet Singh, in the order passed on February 4, observed that 24 students at the school would be forced to take examinations in subjects they had admittedly never studied, solely due to an inadvertent error in data uploaded to the CBSE portal. The petitioners are Class 12 science students of the school. They approached the Court after discovering discrepancies while uploading examination data on the CBSE portal, and after repeated representations by the school seeking correction of the List of Candidates (LOC) elicited no response. Advocate Pramod Gupta, representing the students, stated that in September 2025, the students learnt about discrepancies in the data uploaded to the CBSE portal for their Board examination. These discrepancies include incorrect subjects shown, such as mathematics instead of biology, and vice versa; incorrect names of students and parents, etc. During the hearing, the counsel appearing for the school admitted that mistakes had occurred at the school’s end while uploading the data, expressed regret over the lapse, and supported the students’ case. “I am of the view that if the petition is not entertained, the petitioners will be compelled to appear in examinations for subjects which they admittedly never studied, solely on account of an inadvertent error in the subjects uploaded on the portal of respondent No. 1 (CBSE),” the judge said. The court directed CBSE to correct the subjects and other details of the petitioners forthwith and take all necessary corrective measures. It also clarified that the petitioners shall be permitted to participate in their Class XII Board examinations as well as practical examinations. The court further directed the Department of Education (DoE) to conduct an inquiry into the functioning of Apex Public School, Sant Nagar, Delhi and submit a detailed report to CBSE for appropriate action.
