The Thiruvananthapuram Judicial First Class Magistrate Court III will deliver its verdict on a plea seeking the cancellation of the anticipatory bail granted to Palakkad MLA Rahul Mamkootathil in a sexual abuse case on March 19. The prosecution argued that the legislator had called the survivor with the intention of threatening her. It was also alleged that the MLA submitted incorrect documents before the court. Claiming that his actions amounted to an invasion of the survivor’s privacy, the prosecution stated the failure to cancel the bail would send a wrong message to society. The plea to revoke the anticipatory bail was filed on the grounds that Mr. Mamkootathil violated bail conditions in connection with a second rape case registered against him. The special investigation team submitted before the court that Mr. Mamkootathil contacted the complainant in an attempt to influence her and discourage her from pursuing further legal action. It also rejected the MLA’s claim that the call was made accidentally, claiming that an accidental call would only occur if the number appears in the recent call history. It was further stated that the call to the complainant was made soon after her confidential statement was recorded.
