Emphasising that appellate scrutiny is a routine part of the judicial process, the Delhi High Court has said that setting aside or modifying a lower court’s order cannot by itself be seen as a comment on the competence or integrity of the judge who passed it. Justice Swarana Kanta Sharma made the observation on Wednesday while dealing with an application filed by an Additional Sessions Judge seeking deletion of certain “adverse remarks” made against him by the High Court in an earlier judgment.
