The prosecution in the sexual assault case registered against Palakkad MLA Rahul Mamkootathil submitted before the Thiruvananthapuram Judicial First Class Magistrate Court III on Tuesday that he violated the fundamental conditions of his bail. Seeking the immediate cancellation of the anticipatory bail granted to the expelled Congress leader, the prosecution accused him of attempting to influence the survivor after she had rendered her confidential statement to the court. Outlining its opening arguments in the court, the prosecution contended that the accused had attempted to establish contact with the survivor, despite a clear bail condition prohibiting any such communication. The bail order had specifically directed that the accused “shall not attempt to contact the survivor either directly or indirectly.” According to the Special Investigation Team, the accused attempted to reach the survivor via a WhatsApp call. This prompted her to alert the police about the approach. The prosecution also stated that the survivor was allegedly picked up from a bus stop on the day of their first meeting and taken to a homestay where the assault occurred. Given that similar allegations had been raised by other women, the court had previously instituted stringent conditions to ensure the safety of the witness and the integrity of the investigation. By disregarding the court’s directive to refrain from any form of contact, the accused had forfeited his right to remain on bail, the prosecution stated. The case will be further heard on March 13.
