File picture for representation | Photo Credit: ANI The Supreme Court on Tuesday (February 10, 2026) agreed to schedule an urgent hearing for a petition filed by the Communist Party of India (Marxist) seeking the registration of an FIR and the constitution of an SIT to investigate the alleged hate speeches of Assam CM Himanta Biswa Sarma, as well as a recent social media post. The post, since deleted, showed him “discharging a firearm toward an animated image of two visibly Muslim men positioned within the crosshairs of the weapon,” after which their photograph is depicted as being struck by successive gunshots. The video is accompanied by, and in parts overlaid with, textual phrases such as ‘point blank shot’ and ‘no mercy’. A bench comprising Chief Justice of India Surya Kant and Justices Joymalya Bagchi and N.V. Anjaria took note of the submissions of lawyer Nizam Pasha, appearing for a few CPI and CPI(M) leaders, against Sarma and said it will consider listing the plea. “We seek urgent intervention of this court with respect to disturbing speeches made by the sitting CM of Assam, including a recent video posted where he is shown as shooting at members of a particular community. Complaints filed, but no FIR is registered,” the lawyer said. The CJI said, “The problem is, as soon as elections come, part of the election is fought in the Supreme Court. That is the problem.
